SEARCHING FOR TWO OR THREE JOHN BERRY’S
In the 1800
Orange County census
William and Hannah Cate Berry
list one male under 10 years old. They had at least one more son Thomas
Person Berry who was born in 1807. I have no record of
any children born to them between 1799 and 1807. This is odd that so
much time would pass with no new babys.
Thomas and Sarah
Cate Berry
had two children, a son David and a daughter Eleanor .
Between 1807 and
1810
something happened to the marriage of William and Hannah. There are two
facts
that support this.
FACT 1: In the 1810
Orange County N.C. census
Hannah Berry
listed as head of household next door to Robert Berry.
FACT 2: Hannah Berry and John Berry 3
had a
daughter named Elizabeth Berry who was born in 1812.
I think Hannah Berry and two of her children (Elizabeth by John Berry 3
and Thomas Person Berry by William) moved in with Henry Berry
after Robert Berry died in 1814.
Hannah and William Berry's oldest son would have been 15 years old at
that time and may have been living with his father or his mother. I do
not know the name of William and Hannah Berry's oldest son .
Thomas
Person Berry signed the
wedding bond
for Theodoric Franklin and Elizabeth Berry in 1832.
Temperance Jane
Franklin was the oldest daughter of Theodric and Elizabeth . Temperance
named Hannah Berry and John Berry 3 as her Grandmother and
Grandfather in her bible. We do not know if
this John
Berry 3 is the son of Robert Berry or not. My thinking at
this time is
that John
Berry 3 who had a child by Hannah Berry was not the son of
Robert
but most likely a grandson.
Elizabeth
Franklin
was
staying with Thomas Person Berry at the time the 1860 census was taken.
This
was after her husband and her Mother both died in 1858. There was
a worldwide flu epidemic in that year.
In the 1810 Orange County census Hannah listed 4
boys under
the age of ten, one girl under the age of 15 and two females over 26
and under 45 years old (1765 -1784).
Hannah was born in 1770 determined by the 1850 census. It was suggested
by
Descendants of the Thomas Berry Family in
Tennessee
that the 1810 enumeration was
composed of Hannah, her sister Sarah, and their children. I
am inclined to agree
with this. After Thomas died Sarah married John Pigg in
1815 and died 60 years later in
Wayne County Tennessee on May 7 1875.
Robert Berry wrote a will in 1812 and in this will he stated that
Thomas and
John 1
were both deceased. William was apparently not deceased at this time.
However I
do not know where William was after 1806/07 .
If Elizabeth Berry's father was John Berry 1 (the
son of Robert) he had to be alive as
late as 1811
This would mean that John 1 had died between 1811 and
1812. We have never found a record of a
marriage
between John
Berry 3
and Hannah
Berry. Or of John Berry 1 and
anybody.
As a matter of fact I had not known that Thomas Person Berry had
a half
sister until I made Contact on the Internet with Liz Merkle who is
a
descendant of Theodric and Elizabeth Berry Franklin.
After looking at all the facts about John Berry 1
(son of Robert) I now think that John Berry 4
who married Martha Collier and died about 1804 in Georgia leaving five
orphan children was probably the son of Robert. Their children s
names were Joshua, Robert, Polly, Betsie, and William. (reference
Georgia Intestate Records by Jennette Holland Auston 1986
publication). The fact of the identical names of Robert Berry's
children and the care of the estate and the orphans by
Benjamin Camp and William Cates indicates a close connection to Robert
Berry from
Orange County N.C . At the very least this John Berry 4
had to be related to Robert Berry in Orange County N.C. if he is not
his son. No marriage record has been found for Mary Berry Camp, Robert
Berry Jr. or John
Berry 1. I think the reason for this is that marriage records
were
not being kept at the time these three children of Robert got married.
Marry Berry Camp removed to Georgia around
1781.
John Berry 4
died in Georgia about 1804 and something happened to Martha Collier
Berry about the same time making their five children orphans.
For a long time I thought that John Berry 1 (son of Robert) was either too
young to get married of one of the older children that got married
before marriage records were being kept.
Two conditions of Robert Berry's will are met
if this John
Berry 4 (from Georgia) is his son.
1. He was dead by 1812 when the Robert's will was written
2. A Slave was left to John's 1 Heirs (not
Heir) John
Berry 4
(from Georgia) had five children
If John Berry 1
and John
Berry 4 are the same person then he was not John Berry 3
who was the father of Elizabeth Berry by Hannah Berry
At the William Cate estate sale in 1803 many
of the Robert Berry family bought items.
John 1, Henry, David
or Issac did not buy anything.
Robert Sr, Robert, Thomas, William, and Joshua did. David was married
and living in Orange county at the time. David and John 1 were
not
present at the sale or did not buy anything. Henry and Issac were both
single.
John Berry 1
(son of Robert) never listed in any Orange County N.C.census.
Thomas Berry (son of Robert) is supposed to have died in
Tennessee
(Probably Williamson County) and was reportedly killed
by the Indians while searching for available land in that state. This
information comes from the Thomas Berry descendants in
Tennessee. According to them this is folklore that has been
passed
down in his family.
If it was
Sarah and her children who were living with Hannah in
1810 there is a possibility that John Berry 1
may have been killed by the Indians at the same time Thomas was. This
is only for speculation. I doubt that this is what happened.
In the will of Robert Berry (1812) he left one slave to both
Thomas and
John Berry’s 1 heirs.
Robert
only left one pound to William. This
could mean that William had moved out of the state. I say this because
Mary Berry Kemp/Camp's heirs who had lived in Georgia also received one
pound as her inheritance. Another possibility is
that
William may have been out of his father’s favor at the time he wrote
his
will. In
the will written in 1812 by Robert Berry he stated that Thomas, John 1,
and Mary were deceased. He said nothing of William being deceased.
I do not believe that Hannah ever married again but in 1850 she was
living with
Henry Berry who was a brother to
Thomas, John,
and
William. Hannah died in 1858 and the cause
of death was probably the worldwide flu epidemic. She had a grandson
William H.
Berry (son of Thomas Person Berry) to also die that year. William
H.
Berry was only 22 years old when he died. He had just married Sarah
Francis
King (daughter of Thomas and
Mary Polly King) in 1857. Lewis Berry who was a cousin to Thomas Person
Berry
also died in that same year in Orange County
N.C.
Henry Berry died
about 1855. He left
some household goods and some livestock to Hannah Berry but did not
mention her
as his wife or leave any property to her. Henry left the house that he
was
living in to Thomas and Mary (Polly) King in his will. I speculate
That
Mary (Polly) Ashley King was related to the Berry family in some
way. I
now think Polly Ashley may have been related to Hannah Cate Berry.
There was a Franky Ashley that bought a bed at the 1803 William Cate
estate sale. You may view the will that
Henry wrote
on his personal page.
It is most likely that William left the state and married again. He
never listed in Orange County North Carolina
after 1800. Since
William was listed between 16 and 26 years old in the 1800 census he
would been no older than
36 years old in 1810..
NEW EVIDENCE TO CONSIDER
A DNA test in 2004 has connected John Berry 2
who was (born in N.C. in 1815 and moved to Rusk County Texas) to
the Robert
Berry family.
In 2005, A
DNA test has also connected a descendant of
David Berry to the Robert Berry family.
In order
to try to establish who
John Berry's 2 (born in
1815) parents were,
it would be necessary to check the 1820 Orange County Census.
John Berry 2
would have only been 5 years old in 1820.
In the 1820 Orange County N.C.census there were 5 male children under 10 years old listed.
Robert
Berry had 2------Both boys still unknown
as of 2/18/2005 **This is not
Robert Berry Jr. he was too young
David Berry
had 1-----------Robert Berry born in 1812
Roda Berry
had 1------------ John Berry 6
the
Architect whose father John Berry 5
had died before 1800
Henry
Berry had 1-----------Unknown male as of
2/18/2005. Could Henry and
Hannah or John Berry 3
and Hannah have had this child?
Joshua
Berry-------------------- did not have any
males under 10 years old listed
John Berry 1,
Robert's Son----------------------
was dead
Thomas
Berry------------------ was dead
Isaac
Berry ---------------------may have been
mentally incapable of the responsibality of marriage.
William
Berry------------------ was not listed in
Orange County in 1810 or 1820
If William Berry remarried, he and his new wife could have had a son born in 1815 but would have been living in another State or County.
It
is also
possible that Hannah Berry had moved in
with Henry Berry between 1810 & 1820. John Berry 3 who was the
father
of Elizabeth could have had a son by Hannah also, or Henry and Hannah
could have had a son. In Henry's will in 1855 he made no mention of a
wife or any children.
William and Hannah Berry's son that was born in 1799 would have been 16 years old in 1815 and could possibly been married at that age but not likely.
James Berry,
Joshua's son was only 14 in 1815.
Theodoric
Franklin and
Elizabeth Berry (daughter of Hannah Berry and John Berry 3)
were married in 1832.

From the
dates of birth of the
first two Franklin children listed above and where they were born it is
obvious that the
Franklin's
migrated from Orange County N.C. to Alabama between 1832 and 1835.
John
Berry 2(1815) would have been somewhere between 17 and 20 years
old at
that time.
Since
John Berry 2
(1815)
married a girl from Alabama in 1840 and Theodric and Elizabeth Berry
Franklin had a son born in Alabama in 1835, it is possible that John 2 (1815)
migrated to
Alabama
with Theodoric and Elizabeth Berry Franklin.
This would have especially
been
likely if he was a half brother to Elizabeth Berry Franklin.
David
Berry and his family had removed from Orange County N.C. to Georgia
about 10 years earlier in the 1820’s
probably around 1822 but John 2
(1815) would have only been 7 years old at that time and would
have
most likely
have
remained with his parents.
So
at this time all we know about John Berry 2
(1815) prior to 1835 is that
he was born in North Carolina and is related
to the Robert Berry family in Orange County NC which has been
proved by a 36/37
marker DNA. test.
